Lawful bases and data protection rights

Under UK data protection law, we must have a “lawful basis” for collecting and using your personal information. There is a list of possible lawful bases in the UK GDPR. You can find out more about lawful bases, and about your data protection rights, on the ICO's website.

Which lawful basis we rely on may affect your data protection rights, which are set out in brief below.

  • Your right of access — you have the right to ask us for copies of your personal information. There are some exemptions, which means you may not receive all the information you ask for.
  • Your right to rectification — you have the right to ask us to correct or delete personal information you think is inaccurate or incomplete.
  • Your right to erasure — you have the right to ask us to delete your personal information.
  • Your right to restriction of processing — you have the right to ask us to limit how we can use your personal information.
  • Your right to object to processing — you have the right to object to the processing of your personal data. You can always object to direct marketing, and we will stop.
  • Your right to data portability — you have the right to ask that we transfer the personal information you gave us to another organisation, or to you.
  • Your right to withdraw consent — when we use consent as our lawful basis, you have the right to withdraw your consent at any time.

If you make a request, we must respond to you without undue delay and in any event within one month.

To make a data protection rights request, please contact us using the details at the top of this notice.

Our lawful bases for the collection and use of your data

Our lawful basis for collecting or using personal information for service updates or marketing purposes is:

  • Consent — we have permission from you after we gave you all the relevant information. All of your data protection rights may apply, except the right to object. You have the right to withdraw your consent at any time by replying STOP to a text, clicking "unsubscribe" in an email, or emailing hello@soldsooner.org.

Our lawful basis for collecting or using personal information to respond to early access requests is:

  • Legitimate interests — when someone asks us for early access, we need their name, dealership name and contact details so we can call them, answer their questions and set up their free trial. This benefits the person asking, because they get the trial they requested, and it benefits us because we can find our first customers. The impact on people is minimal, as we only use the details they have chosen to give us, and only for this purpose. All of your data protection rights may apply, except the right to portability.

Our lawful basis for collecting or using personal information to contact dealerships about our service is:

  • Legitimate interests — we tell car dealers about a service that may help their business sell cars faster. We only use business contact details that dealerships make publicly available, we always say who we are when we get in touch, and we stop straight away if asked. The impact on people is minimal, as these are business details used only to tell them about our service. All of your data protection rights may apply, except the right to portability.

Our lawful basis for collecting or using personal information to provide our online demo is:

  • Legitimate interests — what you type into our demo is sent to our AI provider so it can write the replies, which lets you try our service. We do not save anything you type, the conversation is forgotten when you leave the page, and we ask visitors not to enter real personal details. All of your data protection rights may apply, except the right to portability.

Our lawful basis for collecting or using personal information to keep our website secure is:

  • Legitimate interests — we need to protect our website, form and demo from spam and overuse. To do this, our hosting provider counts how many requests come from each internet (IP) address over a few minutes and blocks any that send too many. We never store IP addresses ourselves. The impact on people is minimal, as the counts are kept only briefly and used for no other purpose. All of your data protection rights may apply, except the right to portability.

Our lawful basis for collecting or using personal information for dealing with queries, complaints or claims is:

  • Legitimate interests — when someone contacts us with a question, a complaint or a request about our service, we need to keep their name, contact details and the messages between us so we can respond properly, follow up if needed, and keep a record of what was discussed. This benefits the person contacting us, because it means we can answer them and refer back to what they told us, and it benefits us because we can resolve issues and improve the service. The impact on people is minimal, as the information is only what they have chosen to send us, it is not used for any other purpose, and it is not shared with anyone else other than the service providers who host our email and website on our behalf. We do not keep it for longer than we need to, and people can ask us to delete their information at any time. All of your data protection rights may apply, except the right to portability.

Where we get personal information from

  • Directly from you
  • Publicly available sources, such as dealership websites and online listings

How long we keep information

We keep early access details for up to 12 months after you sign up, or until you ask us to delete them, whichever happens first. If you become a customer, we keep them for as long as we provide our service to you.

We keep records of marketing consent until you withdraw it. After that, we keep a short record that you opted out, so we don't contact you again.

We keep dealership contact details and notes of our conversations for up to 12 months after our last contact. If you ask us not to contact you again, we keep only a short record so we can respect your request.

We keep queries, complaints and claims for up to 12 months after they are resolved.

Demo conversations are not kept at all. Our hosting provider's technical logs and spam checks, which include internet (IP) addresses, are deleted automatically after a short period.

To ask us to delete your details at any time, email hello@soldsooner.org.
